I spent nearly a decade in counsel’s chair as a litigator. If you represent both sides of employment disputes long enough, you start to see a definitive pattern. The culprit is rarely a “bad employer.” It is almost always an ordinary business leader who never built the infrastructure required to stop a minor oversight from scaling into a major legal liability, or who relied on policies alone to control behavior.

A Trust Trap
A founder hired a “close friend.” They skipped the timesheets because tracking minutes felt clinical between people who trusted each other. Two years later, the founder was defending a multi-state overtime claim, out tens of thousands of dollars before a settlement offer was even discussed. Trust is a noble instinct, but weak systems make litigious workplaces.
A Panic of Precedent
An organization denied a simple workplace modification because they feared it would “open the floodgates” to similar requests. That is a common anxiety, but the neither the law nor the affected employees find that nervousness compelling. Fear driven-decisions are incredibly expensive.
By the time I was brought into the room, the critical choices had already been made. My job was damage control.
Eventually, I got tired of that job.
